Our conveyancing packages is designed for your budget and needs. We do not offer a "from" price and add on costs. We have a fixed, all inclusive price and are right up front about it. So no hidden surprises! All of our packages include: • No fees for admin or processing should the contract not proceed for any reason. • No fees for finance extension responses. • No fees for Building and Pest negotiations. • No fees for you to visit our office to discuss your contract with us, if required. • No fees for phone calls and emails regarding your contract during the conveyance. There are searches and Body Corporate Fees which are not included in our Standard Package but we will speak with you if there is the need for any of these. Land Purchases
Unregistered Land of Off The Plan If you are buying a block of land in a new estate then there is a high probability that the land has yet to be registered with the titles office. This type of land is called Unregistered Land. You will still need to conduct the mandatory searches relevant to this type of property. Registered Land A block of land that has already been registered with the titles office is called Registered Land. With this type of real property you will still need to conduct the normal mandatory searches. Rural & Commercial Land Some land sales are subject to special rural or commercial conditions. It really depends on which type of property you are purchasing and how much information about that property you would like to know. We do recommend the entire suite of searches to ensure that there are no surprises for you later. We can also tailor a package for you if there are specific searches you may require like flood or outstanding planning issues. All of our packages are managed by a Solicitor so no matter which one you chose your matter is in good hands. |
Searches provide information about the property you are buying. Basic Searches give you the minimum legal requirements needed for a property purchase however we recommend finding as much as you can out about a property. Conveyancing Searches
This search will provide details such as the registered owner of the property any registered encumbrances, administrative advices, covenants and easements. Results of this search provide details of any encumbrances, registered leases or caveats and the real property description and title reference.
Check Title SearchOn the day of settlement another title search is conducted to ensure that the property details have not been altered between when you signed your contract and the day of settlement.
Special Water Meter ReadingThe water meter of the property is read so that water usage can be calculated and adjusted at settlement. This is done so the buyer and seller only pay for their share of the water use and sewage charges.
Rates Balance CheckThis search provides information about any rates owing to the local council. It is used at settlement to adjust the final figures so that the buyer and seller each pay their portion. It does not provide as much information as a Full Rate Search.
Land Tax Clearance CertificateLand tax is attached to the property not any particular owner. Therefore it is important to learn if there are any outstanding amounts payable as a purchaser may be liable for any debt after settlement has occurred.
Enquire NowIt is important to learn if a property has been previously flooded and to what level. The degree of information available depends on local government resources and may vary from council to council.
Full Rates SearchThis search provides detailed rates information for the property although it will not disclose any outstanding infrastructure charges. A full or standard planning and certificate must be obtained if you wish to learn more about these aspects of the property.
Seller PPSR SearchA registered security interest may be held over the property you are buying by a third party not connected with the owner or mortgagee. Such an interest may force liquidation or reposession of the property even after settlement. It is important to discover this prior to a contract becoming unconditional.
Environmental SearchIt is important to the property you are purchasing is not on the Contaminated Land Register or the Environmental Management Register. If your property is listed on either register then you may incur additional costs or even may not use the property the way you want.
Pool Safety Register SearchThis is a very important search which reveals if there is a current pool safety certificate or if a revocation notice has been issued for the property.
A buyer may terminate a contract if no pool safety certificate is issued prior to the pool safety inspection date in the contract. Additionally you as a buyer may terminate the contract if a revocation notice has been issued prior to the contract date.
A lack of a safety certificate may cost you thousands so ensure the property is sound by conducting this search.
If a seller is bankrupt it may affect their ability to settle the property or even sign the original contract. A seller bankruptcy search gives you peace of mind that the seller has the right to sell it to you and your purchase will finalize.
Seller Litigation SearchIf a seller is involved in a civil litigation matter it may prevent settlement or the ability to claim a clean title at settlement. If a search reveals that there is an action afoot we will liaise with you as to what nature and extent of documents may have to be obtained. Documents may include orders, originating applications, appeals, bill of costs and interlocutory proceedings.
Transport & Main Roads SearchA property may be affected by land resumption or current transport proposals such as roads, rail or seaways. It is important that you make yourself aware of these prior to settlement. This search does not reveal any speculative or future proposals that do not have approval.
Survey PlanA Survey Plan is used to confirm that the property described in the contract is the same property you intend to purchase. It validates the title reference, location and property description.
Enquire NowA Queensland Civial Administrative Tribunal (QCAT) search will reveal if the seller and the property is subject to any actions such as a tree or neighbour dispute. By being aware of any matters afoot you may save yourself a substantial amount of money especially in relation to fences or vegetation issues.
Limited Town Planning CertificateMake sure that you can use the property for what you want by searching the town planning information. Results of this search will provide information on current and future use and zoning. This is especially important for home business, redevelopment and investment properties.
Electricity Providor SearchThis search is important especially when it comes to rural properties but also normal suburban real estate as it will show if the property is connected under normal electricity tariff conditions or some other arrangement.
Building Notices SearchThis search will provide information on any enforcement notices and the status of approved building works on the property. The name of this search changes from council to council as does the type of information.
